These Terms govern the use of Praisera by persons who create a Review Author account, submit reviews, edit or delete reviews, report content or interact with Praisera as review authors.

Clients that use Praisera to collect, manage or display reviews are subject to the Terms of Service.

1. Who Praisera is

Praisera is operated by Dmitry Museychuk, a self-employed professional established in Spain, under the trade name Praisera.

2. Acceptance and minimum age

By creating a Review Author account, submitting a review, editing it, deleting it, reporting content or using Praisera as a Review Author, you accept these Terms.

You must be at least 18 years old to create an account or submit reviews through Praisera. By registering or submitting a review, you confirm that you meet this requirement.

Praisera is not directed to minors. If we become aware that an account belongs to a person under 18 years of age, we may suspend it, restrict it, delete it or anonymize the associated data as appropriate.

3. Review Author account

To submit reviews, you must create a Review Author account.

You are responsible for:

providing accurate information;
keeping your credentials secure;
not sharing your account;
maintaining control over the email address associated with your account;
not using the account unlawfully, abusively, fraudulently or in breach of these Terms.

You may sign in with a password or, where available, through the identity providers offered by Praisera from time to time. Praisera currently offers sign-in with Google. Google acts under its own terms and privacy policy.

Praisera may suspend, restrict or anonymize an account if it reasonably considers that it has been used unlawfully, abusively, fraudulently, insecurely or in a way that creates legal, privacy, security or Service integrity risk.

4. Visible name

When submitting a review, you may choose how your identity is displayed, for example through an alias or first and last name, where the Service offers that option.

You are responsible for the visible name you choose. You must not use a name that impersonates another person, is misleading, infringes third-party rights, contains unlawful content or includes another person’s personal data without a valid reason.

If you choose to display only your alias, Praisera will use that alias as the visible name in the public review.

5. Submitting reviews

You may submit reviews about products, services or resources made available by Clients through Praisera.

By submitting a review, you represent that:

it reflects your honest opinion or genuine experience;
it is not false, misleading, fabricated, spam or abusive;
it does not impersonate another person;
it is not intended to manipulate ratings, harm competitors or mislead others;
you have the necessary rights or permissions to submit it;
it complies with these Terms and applicable law.

Unless the Service or the Client allows otherwise, you may submit only one review for the same Client resource.

6. Publication and moderation

Praisera provides the technology that Clients use to collect, moderate and display reviews.

Depending on the Client’s plan and configuration, a review may be published automatically, remain pending moderation, be approved, rejected, hidden, responded to by the Client or otherwise managed.

Praisera does not guarantee that a review will be published, remain published, appear in a particular order, appear on a specific website or receive a response from the Client.

The Client may make its own decisions regarding moderation, approval, rejection, response, hiding or non-display of a review. When the Client decides these actions within the available features, that decision is the Client’s responsibility. Praisera may technically implement those decisions as provider of the Service.

Praisera may also restrict, hide, remove, redact, retain as evidence, delete or otherwise act on a review where necessary for legal, privacy, security, reporting, abuse, third-party rights or Service integrity reasons.

Praisera may use technical rules, rate limits, report verification, blocklists, manual review and other proportionate tools to detect or manage unlawful, abusive, false, spam, privacy-invasive or problematic reviews. As of the Effective Date, Praisera does not make final decisions producing legal or similarly significant effects on persons solely by automated means.

7. Prohibited content

You must not submit reviews that:

are unlawful, false, misleading, defamatory, abusive, harassing, threatening, discriminatory or obscene;
infringe copyright, trademarks, privacy, image rights, trade secrets or other third-party rights;
contain another person’s personal data without a valid reason and lawful legal basis;
contain personal data of a person under 18 years of age;
contain sensitive data, such as health data, racial or ethnic origin, political opinions, religious beliefs, trade union membership, biometric data, sex life or sexual orientation;
contain data about criminal offenses, allegations, convictions or security measures;
contain payment cards, passwords, codes, API keys, tokens, identity documents, private addresses or other sensitive identifiers or credentials;
are spam, rating manipulation, duplicate reviews, fake reviews or incentivized reviews without disclosure where such disclosure is required;
include scripts, malicious links, payloads, tracking code or content designed to attack, disrupt, improperly track or compromise the Service;
attempt to bypass moderation, reports, request limits, access controls or security controls.

If you received compensation, a discount, a free product, a benefit or another incentive for submitting a review, you must clearly disclose it where required by law or where failure to disclose it could be misleading. Praisera may remove or restrict incentivized reviews that are not clearly disclosed or that may mislead others.

8. Reports and reconsideration

You may report a review if you believe that it is unlawful, infringes your rights, contains personal data that should not be displayed, is false or misleading, or breaches applicable rules.

You may report through:

the tool integrated into the widget; or
[email protected] or [email protected].

When submitting a report, you must act in good faith and provide accurate information. Praisera may reject unfounded, abusive, duplicate, bad-faith or insufficient reports that do not allow the affected content to be identified.

Reports submitted through the widget may remain pending until the email address used is verified. Praisera may process an unverified report where required by law, where submitted by a competent authority, or where there is sufficient information and a legal, security, privacy, abuse prevention or Service integrity reason justifies it.

If you disagree with a decision on a report or with a restriction applied to your review, you may request reconsideration by replying to the notice or by writing to [email protected]. Reconsideration does not guarantee restoration of the review and does not suspend measures necessary for legal, security, privacy, third-party protection or Service integrity reasons.

This does not limit your right to go to court or, where applicable, to contact the competent Digital Services Coordinator. For privacy matters, you may also contact the competent data protection authority.

9. Editing, deletion and anonymization

You may edit or delete your individual reviews from the Service, unless a review is subject to an active report, review, restriction, dispute, legal hold, legal obligation, security or abuse investigation, or similar process.

When you delete an individual review, Praisera deletes it from its primary systems, subject to backups and any valid reason for retention.

If you delete or anonymize your account, your reviews are not automatically deleted. They may remain associated with an anonymized author, unless you delete individual reviews separately or there is another valid reason for their deletion, restriction or redaction.

If the text of a review identifies you or another person, anonymization of the account may not fully anonymize the text of the review.

Praisera may retain limited records or evidence copies of reported or removed reviews where necessary to document reports, decisions, Statements of Reasons, legal compliance, disputes, abuse prevention or defense against claims. Those evidence copies are not used to republish the review.

10. License to your review

You retain any rights you have in your Review Content.

By submitting a review, you grant Praisera a worldwide, non-exclusive and royalty-free license to host, store, reproduce, process, transmit, display, publish, make available, moderate, restrict, hide, redact, remove, delete and use the Review Content to the extent necessary to:

provide, operate, protect and improve the Service;
display the review through Client widgets or related surfaces;
allow the relevant Client to manage, moderate and respond to reviews;
provide support;
handle reports, disputes, legal requests and takedown processes;
document reports, decisions and Statements of Reasons;
comply with the law;
enforce these Terms;
protect the Service, Clients, Review Authors, visitors and third parties.

You also grant the relevant Client a non-exclusive license to display, moderate and respond to your review through Praisera and through the Client’s own website or resource, subject to use of the Service and the features available to that Client.

If you delete an individual review and there is no active report, dispute, legal hold, backup retention or other valid reason for retention, Praisera will stop using that review on public surfaces of the Service.

11. Relationship with Clients and privacy

Reviews are submitted in relation to products, services or resources of a Client.

The relevant Client may act as controller for certain uses of your review, including collection, moderation and display on its own website or resource. The Client’s privacy notice may also apply.

Praisera is not responsible for Clients’ products, services, websites, customer support, business practices, cookies, tracking technologies, legal notices, privacy notices or responses to reviews.

Praisera acts as an independent controller for the management of Review Author accounts, reports, security, abuse prevention, legal compliance and evidence retention.

The processing of personal data by Praisera is described in the Privacy Policy.

12. Security and misuse

You must not:

share your password;
allow another person to use your account;
access or attempt to access other people’s accounts;
bypass authentication controls, limits or security measures;
use automated tools to create accounts, submit reviews or file reports;
test, scan, attack or examine the Service without prior written authorization;
harass, threaten, defame or abuse another person;
scrape, crawl, harvest or overload the Service;
submit reviews on behalf of another person without authorization;
abuse the reporting process;
breach applicable law.

13. Warranty disclaimers and liability

The Service is provided "as is" and "as available".

Praisera does not guarantee that your review will be published, remain visible, be read, receive a response from the Client, appear on a specific website or be available without interruption.

Praisera is not responsible for the products, services, conduct, websites or business practices of Clients.

To the maximum extent permitted by law, Praisera will not be liable for indirect, incidental, special, consequential, punitive or similar damages, or for loss of data, reputation, opportunities, profits or other intangible losses related to your use of the Service.

Nothing in these Terms limits liability where such limitation is not permitted by applicable law.

14. Changes, governing law and language

Praisera may update these Terms. Substantial changes may be notified through the Service, by email or by other reasonable means where practicable, unless immediate changes are required for legal, security, operational or compliance reasons.

If operation of the Service is transferred to a company or other successor entity, Praisera will update the applicable legal documents to identify the new operator and will notify the change where practicable or legally required.

These Terms are governed by the laws of Spain, without prejudice to applicable mandatory rules. Where legally permitted, the courts and tribunals of Valencia, Spain, will have jurisdiction.

If you act as a consumer or as a natural person protected by mandatory rules, nothing in this section limits the rights, guarantees or forums available to you under the applicable law of your habitual residence.

These Terms are available in Spanish, English and French. All three versions are binding. In case of inconsistency, the English version will prevail, unless applicable law requires otherwise. If a version is unavailable or not up to date, the most recent published version identified by version number and effective date will prevail.
